At Magic, your content is yours alone. Only the friends you select will have access to any part of your data, ensuring privacy according to your preferences.

2- Important information

By accessing or using the App and Services, you agree to the terms of this Policy. If you do not agree with the practices described in this Policy, please do not use the App or Services.

By utilizing our services, you entrust your information to Magic, a service marketed by MAGIC APP SAS. MAGIC APP SAS is responsible for the processing of your data.

2.1- Personal information

You can access and use the app without login, but to create an account and be able to save data and access advanced features, we require your name, date of birth, and phone number. These details enable you to log in to Magic seamlessly.

Your name serves as an identifier, while your date of birth helps us determine if you meet the minimum legal age requirement. Your phone number is utilized for account authentication purposes.

Using a profile picture enhances your personal experience, fostering connections with your loved ones.

Magic accesses your photo gallery to provide you with the best experience to save content on the app from any source including from a photo you might have already taken. Although you have the option to decline this access, granting it enables you to fully enjoy our services and technologies.

Additionally, we may collect information from your mobile device, including device information, location data, and unique identifiers.

In order to provide you with our services, there may be instances where we need to transfer your information to third parties located outside the European Union. For further details on this matter, please refer to following sections 3, 4 and 5 of this document.

2.2- Non-Personal information

We may collect non-personal information automatically when you use our App or Services. This may include information about your device, browsing actions, and usage patterns. Non-personal information does not identify you personally but helps us improve our Services and deliver a better user experience.

We adhere to a data tracking and deletion policy that specifies the duration for which we retain your information. As a general guideline, we retain the information we collect for as long as you actively utilize the Magic app. If you do not access the app for more than 12 months, we will delete the majority of the collected data.

If you reside in the European Union, you have the right to file a complaint with the supervisory authority in your country of residence. In France, you can file a complaint with the CNIL

Lastly, you have the right to provide us with instructions regarding the processing (deletion or retention) of your personal data in the event of your demise.

3- Details on data that we collect

3.1- Data provided to Magic

During the registration process, we collect your name, date of birth, and phone number. To authenticate your account, we might send you an SMS with a verification code. We believe this method of verification is both simpler and more secure compared to using a password. If you do not receive an SMS verification code, you can opt to receive a phone call instead.

If you choose to connect your Magic account to your Facebook, Apple, Google, or other third-party accounts, we may receive information from those accounts, such as your friends or contacts. This information is used to enhance your experience and is subject to the privacy policies or settings of those third party accounts.

While using Magic, you have the option to share data with us on a voluntary basis. This includes your name, email address, phone number, photos, notes, and any other data you choose to provide. By utilizing your device's settings or through photos, you can also share accurate location data with us. Additionally, we may utilize your IP address to approximate your location, even if you do not opt to share your precise position. This feature enables you to organize your contents by location.

During onboarding or upon subsequent acceptance, we provide the option to share your photo gallery with us. This allows you to benefit from features like automatically importing your contents.

You have the ability to directly save contents on Magic by taking a photo, scanning a barcode, or utilizing our manual form. Additionally, you can include a note or review along with the content.

If desired, you can choose to share your address book with Magic. This facilitates finding your friends who are already using Magic and simplifies the process of inviting them. As a precautionary measure, only the phone numbers of your contacts are transmitted to our servers. Furthermore, these phone numbers undergo encryption operations (referred to as "salting" and "hashing"). We prioritize the security of your address book data by rendering it unreadable, ensuring that even internally, no one can access its contents.

3.2- Third Party Data

We may gather information that other users provide to us about you when they utilize our services. For instance, if another user grants us access to the contents of their phone's address book, and you are listed as one of their contacts, we may associate the collected data with other information pertaining to you. This enables us to inform you, for instance, when a friend joins Magic.

Additionally, we have the ability to obtain information from third-party sources and merge it with the data we directly collect through our services. This may involve acquiring information from third parties to assist us in identifying your interests or retrieving your lists of contents. By leveraging these external sources, we enhance and personalize your experience with Magic.

4- Use of information

4.1- Providing and improving the service

We use the information we collect to provide and maintain our Services, authenticate users, process transactions, and improve the functionality and performance of the App.

4.2- Communication

We may use your contact information to send you administrative and promotional emails, push notifications, or other communications related to the Services. You can opt-out of communications at any time.

4.3- Personalization

We may use the information we collect to personalize your experience, such as suggesting relevant content or features based on your preferences and location.

4.4- Analytics and aggregated data

We may use aggregated and anonymized data for analytical purposes, market research, and to improve our Services. This data does not identify you personally.

For example :
o Create a visualization of the most commonly saved contents in each region
o Analyze usage by age group, location, gender
o Perform statistical calculations, globally and anonymously. We will not disclose your identity.
o Study metrics on registrations and in usage funnels. Identifying user groups (e.g., countries, users of different types of phones, operating systems, etc.) is part of the more comprehensive studies Magic can conduct.

5- Sharing of information

A. Service Providers
We may share your information with third-party service providers who assist us in operating our business, such as hosting, data storage, payment processing, customer support, and analytics.

B. Legal Compliance and Protection
We may disclose your information if required by law, legal process, or governmental request, or to protect our rights, property, or safety, or that of our users or others.

C. Business Transfers
In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of the transaction. We will notify you via email or prominent notice on our website before your personal information is transferred and becomes subject to a different privacy policy.

6- Modification of information

Our goal is to offer you simple and useful options for personal data. If you have a Magic account, many of these commands can be customized in your settings. For example you can:

  • Change the information in your profile at any time, decide whether you want to make your profile accessible on search engines, or choose whether others can find your Magic account using your email address.
  • Link your User account to other services (Facebook, Google, Apple or Twitter). For some services (including Facebook), you can also choose whether or not to publish your Magic activity on the service in question.
  • Change the settings of your private content. Private contents are only visible to you, you can choose to make all or part of these contents accessible to others.
  • Choose whether Magic should be customized for you based on information collected from other websites or apps.
  • Close your account at any time. When you close your account, we disable it and delete your contents from Magic, as well as your account data.

7- Transferring your information

Magic is a global service. By using our products or services, you authorize us to transfer and store your information outside your country of residence, including the United States, for the purposes described in these rules. The protection of privacy and the rights of the authorities with regard to access to your personal information in these countries are not necessarily equivalent to those of your country of residence.

8- Data Security

We take reasonable measures to protect the security of your personal information and strive to maintain its accuracy. However, no method of transmission over the internet or electronic storage is completely secure. Therefore, we cannot guarantee absolute security.

9- Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by us. This Policy does not apply to those third-party websites or services. We encourage you to review the privacy policies of those third parties before providing any personal information.

10- Control over your data

  • Confidentiality of Your content: You have the ability to adjust the visibility of each content, making them visible or invisible to your friends. By default, your contents are private and belong solely to you. You can modify this status at the individual content level or apply global settings.
  • Access: We strive to provide you with access to most of the information we have about you, allowing you to conveniently make changes. This can be done through the profile sections of the app. If you require access to any other personal information we may hold, wish to correct it, or request its deletion, please contact us at . However, we may ask for identity verification or additional information before granting access or making updates.
  • Correction: If we have misclassified one of your contents or there is a need for correction, you can request the necessary amendments.
  • Removal: Deleting specific information from the app, such as contents, notes, or reviews, is straightforward and can be done easily.
  • Account Deletion: While we will be saddened to see you go, you have the option to delete your account. You can either contact us directly at or utilize the account deletion feature within the app.
  • Account Restoration: Should you change your mind after requesting an account deletion, you have a 30-day period to restore it. After this time, we will permanently delete your information from our servers. During this period, your account will not be visible to other users.
  • Data Portability: If you desire a comprehensive copy of your data, you can request it by sending an email to
  • Right to Object: You have the right to object to the usage of your data. For most types of data, we provide the option to delete them if you do not want us to use them. 11- Children's Privacy

Our Services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. As an European-based company, we adhere to strict conditions when it comes to utilizing your personal data. At Magic, we primarily rely on one of the following four legal bases:

A. Contract
We require access to your data in order to provide our services as outlined in our Terms of Use. For instance, as Magic is a photo-based app, we need to access your photo gallery and camera to ensure the proper functioning of the app

B. Legitimate Interest
Another legal basis we rely on is the concept of "legitimate interest." This means that we may use your data to deliver and enhance our services, safeguard your information, address support inquiries, or assist you in finding friends. It is important to note that our legitimate interest does not override your right to privacy. We only rely on this basis when we believe that the usage of your data aligns with your privacy expectations and is reasonable and necessary

C. Consent
In certain cases, we may request your explicit consent before utilizing your data. We will ensure that you have the option to revoke your consent, either directly within the app or through the permissions settings on your device. While we do not solely rely on your consent to use your data, we may seek permission to access specific data, such as your address book, location data, or photo gallery, through your device's permissions.

There are instances where we may be legally obligated to use your information to comply with applicable laws, such as during a valid court proceeding or when taking steps to protect the rights and safety of our users.

13- Transfer outside European Union

If your friends are outside the European Union, they will be able to see your information. Also, in the context of data transfers to third parties described in the “Sharing of information” section, we can pass your data on to third parties and users outside the European Union, including in countries that do not necessarily have the same level of data protection as those within the European Union. Whenever we pass on your information to third parties outside the European Union, we ensure that adequate mechanisms are in place to protect them, such as the EU-US Privacy Shield or standard contractual clauses.
